Saudi Detention Agency Official Faces Prosecution for Illegal Detention

Riyadh JThe Prisons and Detention Centers Oversight Wing of the Public Prosecution Service took legal action against a detention service officer for unlawfully detaining a person.

An official source at the prosecution said that it has been proven by investigations that the individual was detained without the support of any legal document justifying the detention. The public prosecutor checked the case and wrote to the competent authority to hold the author immediately responsible on the basis of article 40 of the Code of Criminal Procedure.

The source pointed out that the Public Prosecutor’s Office continues its mission of judicial control and inspection to ensure that no one is detained without legal documents or locked up in an undesignated place. The Public Prosecution Service receives complaints from detainees and issues guidelines to deal with detainees strictly in accordance with the provisions of relevant laws.

“The Public Prosecution Service also receives complaints from those who have been detained without any legal document, either through the Public Prosecution e-Portal or via the Public Prosecution Service option on the Absher portal,” the source said while pointing out that individuals have rights and guarantees that their freedoms are not restricted. Nor is it permitted to arrest or detain individuals, except in cases that have a legal basis. Relevant officials carry out round-the-clock monitoring and inspection visits to detention centers to ensure that there are no violations of regulations.

It should be noted that the Criminal Procedure Law and the Imprisonment and Detention Law prohibit restricting the freedom of individuals without legal justification, and emphasize that transgression in these cases justifies strict liability.
