Murder of Xulhaz-Tonoy: the prosecution calls for the death penalty for all the accused


So far four people have been arrested in the case

Concluding its argument, the prosecution demanded on Sunday the death penalty for eight members of Ansar al-Islam in the case of the murder of Xulhaz-Tonoy in Dhaka on April 25, 2016.

Md Golam Sharuar Khan Zakir, the special prosecutor in charge of the case, requested the highest sentence after concluding the prosecution’s plea in a special court.

After concluding the hearing on the prosecution‘s arguments, Judge Md Mojibur Rahman of the Dhaka Special Anti-Terrorism Court set the defense argument on Monday.

The public prosecutor told the court that they were able to prove the charges against the accused.

Previously, the court had completed the recording of prosecution and defense witness statements.

So far, four of the defendants in the case have been arrested. They are: Mozammel Hussain alias Saimon, 25, head of the intelligence and media wing of Ansar al-Islam; Md Arafat Rahman, 24, coordinator of the military branch of Ansar al-Islam; Md Cheikh Abdallah, 27 years old; and a member of the Asadullah Operational Wing, 25.

They were returned to jail after the court appearance on Sunday.

Meanwhile, Syed Md Ziaul Huq alias Major Zia (sacked army major), 42, Akram Hossain, 30, Sabbirul Haque Chowdhury, 26, and Md Zunaid Ahmad alias Maulana Zuned alias Zunaid, 26, are still on the run.

The trial against the eight defendants began on November 19, 2020.

Inspector Md Monirul Islam of the Police Unit Against Terrorism and Transnational Crime (CTTC), who is also the investigating officer in the case, presented the indictment to the court of the Chief Metropolitan Judiciary (CMM) of Dhaka on July 28, 2019.

On July 23, the CTTC police unit filed the indictment against the eight defendants in the case.

On April 25, 2016, Xulhaz, an LGBT activist and local employee of the United States Agency for International Development (USAID), and his friend, theater activist Mahbub Rabbi Tonoy, were machined to death by criminals in the residence of the first in Kalabagan in Dhaka.

On April 26, 2016, Minhaz Mannan Emon, Xulhaz’s brother, filed a murder complaint with the Kalabagan Police Station to seek justice for his brother.

Initially, the Police Detective Division investigated the double murder, but the CTTC took over the case on November 15, 2017.
